Ok, the final results are in.
I must say..Knowing the Law is good!!!
After getting indications that my previous land lord was going to take out many things out of the security deposit that he shouldn't have, I looked up the law on the matter in the internet.
Low and behold, The land lord by colorado state law has 30 days to give back the security deposit, or up to 60 if the lease states it. If they do not give back the deposit with a full description of deductions and reasons for those deductions then he forfits the right to keep any of the deposit. At the time of my research it was only a few days till the 60 day mark. So I bide my time.
It also says that the tenent must give notice of intent to sue 7 days before doing so, thereby giving the landlord a final time to get it back to the tenant. So I bide my time.
On the day I should have recived the security deposit, after any reasonable mail time, I send out a letter. Included in the letter is the Law printed up, and a copy of my receits for the deposit. The letter states that I want the deposit back or I intend to sue. It was then mailed the next day via certified mail.
Two bussness days later, I get my full deposit back. In the notes are "DAM Security deposit paid in full" Slumlord Knows he has been beaten.
Life is good. Christmas is saved on account of cleverness, gall, and the Law.
Yeah!!!!!!!
Dave
Thought people out there should know and be encoraged to stand up for their lawful rights.
Thanks Bellweather for the inspiration of getting what is due earlier with my matter of suing the twofaced unmother for the celphone bill.
Got a 1/3 in settlement from her father on that one.
